Welcome to Target Himalaya Treks Pvt. Ltd. Before booking any of our trekking, tour, mountaineering, expedition, or adventure travel services, please carefully read the following Terms and Conditions. These terms are designed in accordance with the tourism laws and regulations of Nepal and internationally accepted adventure travel standards.
By booking a trip with Target Himalaya Treks, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions. These terms constitute a legally binding agreement between you (“the Client”) and Target Himalaya Treks (“the Company”).
1. BOOKING & PAYMENT POLICY
1.1 Booking Confirmation
A booking is confirmed only after the Company receives:
- A completed booking form,
- A copy of the client’s passport, and
- A non-refundable deposit of 25% of the total trip cost.
1.2 Final Payment
The remaining balance must be paid at least 30 days before the trip departure date unless otherwise agreed in writing.
1.3 Late Bookings
Bookings made within 30 days of departure require full payment at the time of booking.
1.4 Payment Methods
Payments may be made via:
- Bank transfer,
- Credit/debit card,
- Online payment gateway,
- Cash payment in Nepal.
Any bank charges, transaction fees, or currency conversion fees shall be borne by the client.
1.5 Pricing Policy
Trip prices are based on current transportation costs, government taxes, permit fees, and exchange rates. The Company reserves the right to revise prices in the event of significant changes beyond its control.
2. CANCELLATION & REFUND POLICY
2.1 Cancellation by Client
If a client cancels a confirmed booking, the following cancellation charges will apply:
- More than 30 days before departure: 25% retained
- 15–30 days before departure: 50% retained
- Less than 15 days before departure: 100% retained
No refunds will be made for:
- Unused services,
- Voluntary withdrawal from the trip,
- Late arrival,
- Early departure,
- Missed meals, accommodation, or transportation.
2.2 Cancellation by the Company
Target Himalaya Treks reserves the right to cancel any trip due to:
- Natural disasters,
- Political unrest,
- Government restrictions,
- Pandemics,
- Insufficient participant numbers,
- Safety concerns beyond our control.
In such cases, clients may choose:
- An alternative trip,
- Postponement of the trip, or
- A refund of payments made to the Company excluding non-recoverable third-party expenses.
The Company shall not be liable for additional expenses such as:
- International flight tickets,
- Visa fees,
- Insurance claims,
- Personal equipment costs.
3. TRAVEL INSURANCE
3.1 Mandatory Insurance
Comprehensive travel insurance is mandatory for all clients participating in trekking, climbing, mountaineering, and adventure activities in Nepal.
Insurance coverage must include:
- Emergency helicopter evacuation,
- Medical treatment,
- Accidental death and disability,
- Search and rescue,
- Trip cancellation,
- Repatriation expenses,
- Loss of baggage and personal belongings.
3.2 Proof of Insurance
Clients must provide proof of valid insurance before the commencement of the trip.
Failure to obtain adequate insurance is entirely the client’s responsibility.
4. PASSPORT, VISA & TRAVEL DOCUMENTS
Clients are solely responsible for:
- Obtaining a valid passport with at least 6 months validity,
- Securing a Nepal entry visa,
- Obtaining permits and travel documentation required for the trip.
The Company is not responsible for denied visas, immigration delays, or refusal of entry into Nepal or neighboring countries.
5. HEALTH, FITNESS & MEDICAL CONDITIONS
5.1 Fitness Requirement
Clients must ensure that they are physically and mentally capable of participating in the selected trip.
5.2 Medical Disclosure
Clients must inform the Company in writing about:
- Pre-existing medical conditions,
- Allergies,
- Physical disabilities,
- Current medications,
- Mental health concerns.
Failure to disclose relevant medical information may result in removal from the trip without refund.
5.3 Medical Emergencies
In the event of illness or injury, the Company reserves the right to arrange emergency evacuation or medical treatment deemed necessary by guides or medical professionals. All related expenses are the responsibility of the client.
6. ITINERARY CHANGES & FLEXIBILITY
Adventure travel in Nepal involves uncertainties caused by:
- Weather conditions,
- Flight delays,
- Landslides,
- Political events,
- Road blockages,
- Health or safety concerns.
Therefore, the itinerary may need to be modified, delayed, or canceled.
The Company reserves the right to:
- Change routes,
- Substitute accommodations,
- Alter transportation,
- Modify schedules,
- Replace guides or staff if necessary.
Additional costs resulting from unforeseen circumstances shall be borne by the client.
7. TREKKING, CLIMBING & ADVENTURE RISKS
Clients acknowledge that trekking and mountaineering involve inherent risks including:
- Altitude sickness,
- Avalanches,
- Falling rocks,
- Ice and snow hazards,
- Extreme weather,
- River crossings,
- Wildlife encounters,
- Physical injury or death.
Participation is entirely at the client’s own risk.
Clients agree to follow the instructions of guides, climbing leaders, and local authorities at all times.
8. GUIDE & STAFF AUTHORITY
The decision of the Company’s guides, trekking leaders, or expedition staff regarding:
- Safety,
- Health,
- Weather conditions,
- Route changes,
- Participation continuation,
shall be final and binding.
The Company reserves the right to remove any participant whose behavior:
- Endangers the group,
- Violates local laws,
- Causes disruption,
- Abuses staff or fellow travelers.
No refund shall be provided in such cases.
9. PERSONAL BELONGINGS & BAGGAGE
Clients are responsible for safeguarding their:
- Passport,
- Money,
- Electronics devices
- Luggage,
- Trekking equipment,
- Personal belongings.
The Company is not liable for:
- Theft,
- Loss,
- Damage,
- Delayed baggage,
- Airline baggage issues.
We strongly recommend avoiding unnecessary valuables during trekking.
10. ENVIRONMENTAL & CULTURAL RESPONSIBILITY
Clients are expected to:
- Respect local customs, traditions, and religious sites,
- Protect the environment,
- Avoid littering,
- Follow Leave No Trace principles,
- Respect wildlife and natural habitats.
Illegal activities including:
- Drug use,
- Wildlife trafficking,
- Cultural artifact removal,
- Environmental damage,
are strictly prohibited and may result in immediate removal from the trip and reporting to local authorities.
11. FLIGHTS & TRANSPORTATION
Domestic flights in Nepal, especially in mountain regions such as Lukla, Jomsom, and Dolpo, are highly weather-dependent.
The Company is not responsible for:
- Flight delays,
- Flight cancellations,
- Missed international connections,
- Additional accommodation costs due to delays.
Clients are advised to keep extra buffer days in their travel schedule.
12. PHOTOGRAPHY & MEDIA USE
The Company may use photographs or videos taken during trips for:
- Promotional materials,
- Social media,
- Websites,
- Marketing publications.
Clients who do not wish their images to be used must notify the Company in writing before the trip begins.
13. CHILD POLICY
Participants under 18 years of age must:
- Travel with a parent or legal guardian, or
- Provide signed consent documents.
The Company reserves the right to impose age restrictions on certain adventure activities.
14. FORCE MAJEURE
Target Himalaya Treks shall not be held responsible for delays, cancellations, losses, injuries, or damages caused by events beyond its reasonable control, including but not limited to:
- Natural disasters,
- Earthquakes,
- Floods,
- Pandemics,
- Government restrictions,
- Political unrest,
- War,
- Strikes,
- Terrorism,
- Weather conditions.
No compensation shall be payable under such circumstances.
15. COMPLAINTS & DISPUTE RESOLUTION
15.1 During the Trip
Any complaints must be reported immediately to the guide or Company representative so reasonable efforts can be made to resolve the issue.
15.2 After the Trip
If unresolved, complaints must be submitted in writing within 15 days after completion of the trip.
15.3 Legal Jurisdiction
Any disputes arising from these Terms and Conditions shall be governed by the laws of Nepal and fall under the exclusive jurisdiction of the courts of Nepal.
16. PRIVACY POLICY
The Company respects client privacy and personal data. Information collected during booking will be used solely for:
- Trip operations,
- Permit processing,
- Emergency contact purposes,
- Legal requirements.
Client information will not be sold or shared with unauthorized third parties.
17. ACCEPTANCE OF TERMS
By booking a trip with Target Himalaya Treks, the client confirms that:
- They have read and understood these Terms and Conditions,
- They accept the inherent risks of adventure travel,
- They agree to comply with Company policies and guide instructions,
- They participate voluntarily and at their own risk.
